Terms of Use
These Terms of Use (“Terms”) govern your use of the mobile applications DaterUp! and Cacao & Coffee (each an “App”) published by Sanabria Technologies LLC (“Sanabria Technologies,” “we,” “us” or “our”), and of our website, sanabriatech.com. By downloading, accessing or using an App, you agree to these Terms. If you do not agree, do not use the Apps.
Eligibility
You must be at least 18 years old to use the Apps. By using an App, you represent that you meet this requirement and are able to enter into a binding agreement.
License to use the Apps
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps for your personal, non-commercial use on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, distribute, sell, rent, reverse engineer or create derivative works of the Apps, except as permitted by applicable law.
Subscriptions, free trials and billing
Each App is free to download and offers optional auto-renewable premium subscriptions (for example, monthly and yearly plans). Current prices are shown in the App and on the App Store before you purchase, and may vary by country.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: your subscription automatically renews for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
- Managing and cancelling: you can manage or cancel your subscription at any time in your device’s Settings → [your name] → Subscriptions, or in your App Store account settings. Cancellation takes effect at the end of the current billing period.
- Free trials: if a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
App content and disclaimers
DaterUp!
DaterUp! provides personality-based dating guidance, conversation ideas and compatibility insights informed in part by astrological concepts. This content is offered for general information and entertainment purposes only. It is not professional, psychological, relationship or safety advice, and it does not guarantee any outcome. Use your own judgment, and always take appropriate safety precautions when meeting people you do not know.
Cacao & Coffee
Cacao & Coffee provides coffee and chocolate pairing suggestions for general information and enjoyment. It is not nutritional, medical or dietary advice. Products may contain caffeine, dairy, nuts, soy or other allergens. Check product labels and consult a healthcare professional if you have allergies, sensitivities or health concerns.
Acceptable use
You agree not to misuse the Apps, including by attempting to interfere with their operation, bypass purchase or security features, access them by automated means, or use them for any unlawful purpose.
Intellectual property
The Apps, the Site and all related content, designs, text, graphics and software are owned by Sanabria Technologies or its licensors and are protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.
Privacy
Our handling of information is described in our Privacy Policy, which forms part of these Terms.
Disclaimer of warranties
The Apps and Site are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Apps will be uninterrupted, error-free or meet your requirements.
Limitation of liability
To the maximum extent permitted by law, Sanabria Technologies will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from or related to your use of the Apps or Site. Our total liability for any claim relating to the Apps will not exceed the amount you paid for the App subscription in the twelve (12) months before the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Termination
We may suspend or terminate your access to the Apps if you violate these Terms. You may stop using the Apps at any time by deleting them. Termination does not cancel an active App Store subscription; cancel it in your Apple ID settings.
Apple-specific terms
These Terms are between you and Sanabria Technologies only, not Apple Inc. (“Apple”). Apple is not responsible for the Apps or their content and has no obligation to provide maintenance or support for them. In the event of any failure of an App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or a third party relating to the Apps, including product-liability claims, claims that an App fails to conform to legal or regulatory requirements, consumer-protection or privacy claims, or claims of intellectual-property infringement. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the Apps. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Governing law
These Terms are governed by the laws of the United States and the state in which Sanabria Technologies LLC is organized, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable rights you have under the consumer-protection laws of your country of residence.
Changes to these Terms
We may update these Terms from time to time. Updated Terms take effect when posted, and the “Last updated” date above will change. Continued use of the Apps after an update means you accept the revised Terms.
